For this contract, “Brave and Faithful K9”, “BFK9” and “Seller” are one in the same represented by Greg Clouse, Janie Clouse, and Megan Clouse.

Brave and Faithful K9 has the right to refuse the sale of a puppy/dog to any customer, at any time, at the Seller’s sole discretion. If the Seller refuses to sell the puppy/dog after a deposit has already been placed by the Buyer, the Seller will return the Buyer's deposit in full unless it falls within the exception under the Deposit/Sale Agreement.

Purchase Price: (BUYER INITIALS____)

The puppy/dog purchase price for this litter is $ including deposit. This price is mutually acknowledged by both Buyer and Seller. All sales are final and the puppy/dog is being sold on an "As Is" basis, with the exception stated in the Health Guarantee.

Deposit/Sale Agreement:  (BUYER INITIALS____)

A minimum deposit of $500.00 is required per puppy/dog in order for it to be held for the Buyer. After making a deposit should the Buyer decide not to buy a puppy/dog for whatever reason, the deposit will NOT be refunded.

The remainder of the Buyer's payment for a puppy/dog must be Paid In Full and Processed BEFORE the Buyer picks up their puppy/dog unless a final payment in CASH is being made; CASH is accepted as a final transaction on Puppy/Dog Pick Up Day. Allow 7 full business days for processing that are not CASH. If the puppy/dog is shipped to the Buyer, the puppy/dog must be paid for in FULL PRIOR to it being shipped. The Buyer is responsible for all shipping costs. ONLY the Following Forms of Payment are Accepted:

  1. Bank Transfer through BFK9 Invoicing: a 1% transaction fee is applied for this form of payment

  2. Credit Card Transaction Through BFK9 Invoicing: a 3% transaction fee will be applied for this form of payment.

  3. Cash (Only accepted at in-person transactions)

*We DO NOT accept Personal Checks, Money Orders, Cashier’s Checks or any other form of payment than those listed above.

Departure: (BUYERS INITIALS____)

Brave and Faithful K9 does not typically let a puppy leave until it is a minimum of 8 weeks old. We feel this gives the Seller and the Buyer the best opportunity to evaluate the puppy’s temperament to ensure the Buyer picks the best puppy for their home. Once a deposit on a puppy younger than the age of 8 weeks old has been made, the puppy/dog must be picked up or shipped no later than the pre-scheduled and pre-agreed upon Puppy Pick-Up Date by the Buyer and Seller unless other arrangements have been agreed upon in writing by the Buyer and the Seller. If the Buyer has not personally picked up or has not had shipped His/Her reserved puppy during this allotted time, there will be an additional cost of $50.00 per day for boarding; in addition, food and any necessary veterinary care will be covered by the Buyer. If any of these fees are accrued, they must be paid prior to the puppy/dog’s departure. If payment is not made, should any of these fees be additionally accrued, the puppy will not be released to the Buyer. Should the Buyer refuse to pay for additionally accrued fees, all monies previously paid by the Buyer for the purchase of the puppy will be forfeit (not returned to the Buyer), the contract will be void, the puppy will remain the property of BFK9 and be advertised as available for purchase for new clients.

 

(DEPOSIT EXCEPTION) This DOES NOT apply to puppies that are enrolled through contract in our Brave and Faithful K9 Puppy Blueprints Phase 2 Board and Train program.

 

The Seller agrees to provide AKC Registration information, a copy of the Buyer/Seller contract, and a copy of the puppy/dog’s vaccination records on the agreed upon pick-up day of the puppy/dog or as soon as possible after the puppy/dog was shipped.

Health Guarantee/Sale Agreement:  (BUYER INITIALS____)

The Seller asserts that the Buyer's puppy/dog has been examined by a licensed veterinarian with a passing Initial Puppy Health Exam. The Seller also asserts that all vaccinations and any additional veterinary care for the puppy/dog has been provided by a licensed veterinarian. The Seller agrees that the puppy/dog will go to its new home up-to-date on all age-appropriate vaccinations and deworming. The Buyer will be provided with current official vaccination records.

The Buyer agrees to maintain the puppy’s/dog’s yearly health check, vaccinations, and deworming schedule through a licensed veterinarian for the first year of the puppy’s/dog’s life according to the AKC Vaccination Schedule listed below in this contract.  The Buyer agrees to do, at minimum, the “recommended” vaccinations in the AKC Vaccination Schedule listed below in this contract.  If the Buyer fails to maintain from the date of purchase the puppy’s yearly health check, vaccinations, and deworming through a licensed veterinarian, the entirety of this contract will be void.  The Buyer will be responsible for providing BFK9 with these records. Any changes to this agreement must be stated in the addendum and agreed upon by signatures of Buyer and Seller.

The Buyer agrees that the Seller is not responsible for any injuries or neglect the puppy/dog incurs after the pick-up/ship date or anytime thereafter. The Seller is not liable for any tests, medications, or veterinarian expenses due to injury after the pick-up/ship date. All veterinarian/medical bills accumulated by the Buyer after the pick-up/ship date of the puppy/dog are the financial responsibility of the Buyer.  At the time of sale of listed puppy, the health and temperament of the listed puppy/dog is considered to be excellent to the best of the Seller's knowledge and according to the results of the licensed veterinary exam(s) of listed puppy.

 

The Buyer agrees to provide the puppy/dog with the proper training and environment necessary for the puppy/dog's proper health and temperament development. Once the puppy/dog is released from Brave and Faithful K9's care, Brave and Faithful K9 is responsible for neither continued training nor of the development of the natural drives that were exhibited by the puppy/dog and developed while in our Brave and Faithful K9's care. This responsibility resides solely on the puppy/dog's owner. The Buyer agrees that the Seller shall not be held financially or legally responsible/liable for any damages, physical injuries, or emotional problems caused by the Buyer's puppy/dog.

The Seller agrees to have the Buyer's puppy/dog on a nutritious diet and encourages the Buyer to continue with either the same diet or to slowly mix the brand of puppy food that the Buyer prefers with the brand of food that the Seller is currently using to minimize digestive issues.

*Although we do have knowledge of proper care for our puppies and adult dogs, we are not licensed veterinarians. We choose to have all of the care for our puppies and adult dogs provided by licensed veterinarians. We also obtain education from our own veterinarians on the care for our puppies and adult dogs. With this in mind, we ask you to please refer to your own personal veterinarian for all veterinary care questions for your puppy once the puppy is in your ownership. It is important for a licensed veterinarian to have first-hand knowledge about your puppy/dog in order to provide you with the best possible care and education:

Puppy’s Age Recommended Vaccinations

6 — 8 weeks Distemper, measles, parainfluenza

10 — 12 weeks DHPP (vaccines for distemper, adenovirus [hepatitis], parainfluenza, and parvovirus)

12 — 24 weeks Rabies 

14 — 16 weeks DHPP

12 — 16 months Rabies, DHPP

Every 1 — 2 years DHPP 

Every 1 — 3 years Rabies (as required by law)

Hip & Elbow Guarantee: (BUYER INITIALS____)

At Brave and Faithful K9, we take it very seriously to only breed dogs which have CERTIFIED passing hip/elbow scores through well-known dog organizations like:  OFA, FCI, or the SV in Germany.  We also examine a dog’s pedigree to see if there are any hip/elbow issues in said dog’s pedigree.  It is important to understand that genetic and/or environmental factors play a part in the development of hip dysplasia. Known environmental factors such as puppies being allowed to repeatedly jump off things taller than themselves, poor diet, being overweight, and over-exercising can increase the risk of hip/elbow injuries in young puppies which can lead to dysplasia. At Brave and Faithful K9, we raise our puppies/young dogs in a controlled environment to help reduce the environmental effects of hip dysplasia.

 

However, since we cannot control the environment the puppies are raised in when they leave Brave and Faithful K9, this contract does not cover hip/elbow problems that are environmentally induced.  The Buyer agrees to maintain preventative care of the puppy/dog in regards to hip dysplasia and overall health such as proper nutrition, proper exercise, and preventing stress injuries. If this puppy/dog develops crippling (to become unable to move or walk properly) hip dysplasia at any time from date of purchase to 12 months of age (confirmed by X-rays from a competent licensed veterinarian and the veterinarian confirms that the puppy/dog has also been given proper preventative joint care) the puppy/dog shall be returned to the Seller at the expense of the Buyer. The puppy will be replaced with a puppy of equal value from the next litter of listed Dam. The Seller will not agree to replace a puppy until they have received a copy of the x-rays accompanied by a letter from the veterinarian stating thee above listed circumstances for crippling hip dysplasia.  This letter should also include proof of regular vet visits that documented a healthy maintained weight up to the diagnosis of hip dysplasia.  The Seller reserves the right to have the hip X-rays examined by a board-certified veterinary radiologist, a veterinarian of the Seller's choice, and/or an OFA radiologist before the puppy/dog is replaced. Should the Buyer prefer to retain said puppy/dog, the Buyer thereby forfeits any replacement puppy/dog, unless other arrangements are mutually agreed upon.  Brave and Faithful K9 will only replace a puppy once. If the replacement of a puppy is provided due to the above-mentioned circumstance, the replacement puppy will not have any guarantees included. 

Transfer/Sale Agreement: (BUYER INITIALS____)

The Seller prefers to personally give the puppy over to the Buyer.  But, arrangements can be made for the puppy to be shipped at the Buyer's expense.  For the puppy/dog's protection, it will not leave the Seller's possession prior to 8 weeks of age. This allows the puppy to reap the maximum benefit from its mother and ensures both the Buyer and Seller that the puppy is ready for its new home.

 

AKC Registration/Breeding Rights: (BUYER INITIALS____) 

All puppies/dogs are sold from the Seller to the Buyer under Limited AKC registration (limited breeding rights). Full AKC registration will be granted by the Seller upon the puppy/dog achieving one of the following titles: BH Title through either the United Schutzhund Clubs of America or LV DVG America Club or other similar obedience titles from AKC, Mondioring, French Ring, or other titles approved by BFK9.  A copy of the BH certificate or other certificates and score book must be submitted to the Seller.  In addition, all puppies/dogs considered for Full AKC Registration must have their hips and elbows evaluated by a licensed veterinarian and have a passing hip and elbow score either through OFA Certification or the SV-(GSDWDA) no exceptions.  Any BFK9 puppy/dog bred before attaining one of the aforementioned titles and obtaining certified hips and elbows through OFA or the SV-(GSDWDA) will never be given Full Registration Rights and the Health Guarantee will be VOID.  Copies of an official hip and elbow rating/score must be presented to the Seller.  

 

Seller Commitment: (BUYER INITIALS)

At Brave and Faithful K9 we are passionate about providing services that go ABOVE and BEYOND simply producing and selling puppies and dogs. 

We provide our clients with:

  1. An experience that includes honesty and integrity

  2. Treating our clients with individual importance and hospitality

  3. Education in preparation for a new puppy/dog

  4. Ultimately, placing the right puppy/dog into the right home for the best possible outcome of the desires of the client and for the perfect “Furever Home” for the puppy/dog.

We do this by:

  1. Listening closely to the details of the desired purpose and goals that our clients have for their new puppy/dog. 

  2. Looking at all aspects of our puppies/dogs through professional temperament and environmental testing.

  3. Evaluating the natural drives of the puppy/dog

  4. Recommending particular pairings of our dams and chosen sires for the best possible candidates for producing the desired temperament and workability,

  5. And YES! We even make it our goal to work to provide the puppy/dog with the specific coat types and colors in which our clients are desiring. 

We are constantly striving to make all of our customers happy and satisfied with their buying experience and their new puppy/dog. We work very hard to ensure we are breeding documented healthy, working-line German shepherds with excellent temperaments.  We want all of our clients to be elated with their GSD for many years to come.  

Buyer Commitment:  (BUYER INITIALS____)

The Buyer commits to prior education concerning the type of care that adding a new life/puppy/dog to the home will entail. The Buyer commits to the long-term care and development of the puppy/dog once in their care. The Buyer does not take lightly that caring for a new life in their possession that will depend solely on them. This is a commitment of working through all aspects of adding a new puppy/dog to the home including introductions to family members and current pets. This commitment also includes the understanding that there will be much needed attention, bonding, and basic training that will require time and patience of this new life in their care. Because of this commitment, it is understood that just as one does not return a child to a hospital because of crying, lack of sleep, poopy diapers, sibling rivalry, etc. one does not return a puppy for the natural commitments that come with adding a new puppy/dog life to a home. BFK9 is more than willing to and does provide prior education regarding adding a new puppy/dog to a home. Because of this Buyer commitment and prior education, BFK9 will not under any circumstance (unless otherwise stated in this contract due to health reasons that are covered contractually) refund any monies that have been paid for a puppy/dog once the puppy/dog has left the care of BFK9. Also, BFK9 will only take a puppy back on a case-by-case basis solely at BFK9’s discretion. We believe in personal responsibility.  

Seller First Option: (BUYER INITIALS____)

In the event that Buyer is unable to or simply does not want to keep the puppy/dog and decides to give the puppy/dog away to a new home or sell the puppy/do to a new home, the Buyer agrees to give the Seller First Option to take the puppy/dog back. The Buyer must contact the Seller via email, text message, for phone call and receive a reply back fro the Seller before the puppy/dog is given/sold to another person. The decision to choose First Option resides solely on BFK9 and is considered on a case-by-case basis. If the Seller refuses the First Option, the Buyer has the right to sell the puppy/dog to a good home if the Buyer so chooses.  BFK9 is not responsible for promoting puppies/dogs being rehomed that are not in our care. This is simply due to the fact that we can verify neither the training nor the environment provided after the puppy/dog has left our care. Therefore, we will only promote and sell puppies/dogs in which we have current, first-hand knowledge.

 

Unsatisfied Disagreement Issues: (BUYER INITIALS____)

If for some reason the Buyer is not satisfied with their puppy/dog or has a disagreement at the time of purchase or thereafter, the Seller guarantees to try and purposefully resolve any issues within reason. Should any issue arise, the Buyer agrees to contact the Seller in writing (email preferred) and allow the Seller 30 days to resolve any and all matters before the buyer posts any negative reviews on the internet, news media, social media, or any public/private forums. If such violation is committed by the Buyer, or the Buyer encourages a third party to commit such acts, all guarantees and responsibilities of Seller in this contract are null and void.

*This contract is only applicable to the Buyer and Seller listed on this contract. No part of this contract or the guarantees within this contract will transfer to any additional owners. ​
